To capture Latios in Pokemon Soul Silver you must have obtained the National PokeDex and have exited the Pokemon Fan Club in Vermillion City, Steven Stone of Hoenn will come and tell you that one of them (Latias & Latios) is roaming the land of Kanto.
Latios is at level 35 so be prepared! ^^
Also Latios is in the Pokemon Soul Silver version and Latias is in the Pokemon Heart Gold version! ^_^
