You go to court in the jurisdiction where the child legally resides and file for an order of visitation. Just because your wife filed for divorce, custody/visitation/child support are separate issues and may be modified at the request of either parent at any time. Consult an attorney with specialization in family law in the state of jurisdiction for assistance (ideally), or go the the court of jurisdiction for the proper forms, fill them out, pay the filing fee and wait for your court hearing.
Theres no way she could MAKE you sign off your children. In a divorce you have to fight to try and get custody or visitation time with the kids. And being a father it is hard so you need to fight hard to get what you want and deserve.
the father and mother get divorce and mother fight father so he doesnt see the baby
A divorce is when two parents fight and finally decide to move apart.
You should pay for someone to serve him with divorce papers when you file , but if he does not sign, you will end up in court to get the divorce. There may be some requirements regarding the time between filing for divorce and the final decree. The argument will not be particularly about the restraining order, etc. but perhaps about child custody and visitation (if you have children) and that part may not be pleasant. If he is truly dangerous, you may want to consult with someone to get advice on how you should manage this.
Why doesnt he like you? Have you talked to him about it. IF he has come out and told you that point blank, then get a divorce. Couples have problems everyday but they still love and like one another. They may argue and fight but when it comes down to push or shove, they are there for you. If you feel that your husband wouldn't care one way or another about what happens to you, make him an X.
you do not have to fight at all, go to an attorney and sue for divorce, make sure (your attorney will see to that ) that all your rights are honoured.
To fight for your rights see links
someone who doesnt like to fight
Yes of course you can. Visitation rights or shared custody should be settled when they are babies. There should have been a visitation order entered at the time the father was granted custody. There is no age restriction. Unless you were deemed an unfit parent you have the right to a visitation schedule. You should return to the court that issued the custody order and request a visitation schedule.
Any wife can file for divorce in any state, any time - in accordance with that state's laws regarding "reason" for wanting the divorce. I think a spouse in prison is a good reason. With "no fault" divorce common in most states, you don't need a reason, just the money to pay the attorney!
no he doesnt. not yet i dont think
You can't. If the other party wants out, that's their right.
