In MD, you can only get a drug record expunged if you were a juvenile, pardoned, found not guilty, not prosecuted, or received probation before judgement. If you were actually convicted of an offense, you can only expunge a few minor offenses, and drug offenses are not one of them.

If you and your offense are eligible for expungement, you generally have to wait for 3 years after your acquittal or probation or sentence before you can file. You then file a petition and waiver form with the Clerk of District Court in your county.

The first related link below is the MD Judiciary's page about expungement; it has good links to a brief flyer and a more detailed brochure, and you should download both.

Procedures may vary from county to county, so you should inquire with the Clerk of Court before doing anything. The second related link has contact information for all MD trial courts, and links to their websites.

Can you work as an anethesioligist with an expunged felony record?

Well, let's clarify what it means to expunge a case: it means to DELETE it COMPLETELY. This means essentially THERE IS NO RECORD!! So to have a record EXPUNGED means to have it DELETED. When you have a felony record expunged it's as if it never occurred. Therefore the public cannot see the record, nor can police. And you then have the legal right to say you don't have a record (at least not that one: if you do not have any other record you have NO record). Therefore to answer your question, YES, you can work as an anesthesiologist with an expunged record.

A criminal record is expunged of each individual offense at a time, on the order of the Court. You would have to petition the Court for each individual offense you wished expunged from your record. Whether or not it's expunged is entirely up to the Court.

Can you be denied employment for misdemeanor drug possession?

Generally speaking, no. However, you say "charge", not "conviction". If you were not convicted of the drug charge, you can go to the Court and file a motion to have the record expunged (destroyed). If you get your record expunged, it is like it never existed, and you can work in the Crim Justice field.
