What scheme can I pay into for workers compensation?

Workers comp laws differ from place to place. Check with your place of work to see if they have any information. Failing that, talk to your local law offices or with an insurance company like Aflac.

If my company uses contract labor and gives them a 1099 am I required to pay workman's comp insurance on them?

It depends on your state. For example, Texas is the only voluntary state for Workers' Comp. BUT, it, like all states, says that if you don't carry the coverage you remain liable for your workers AND you lose your sole remedy (which means people can sue your company for workers' injuries - not only the worker, but his spouse, kids...) Not all states say you have to cover 1099 workers, but many do - including the voluntary Comp state of Texas - if your subcontractors don't have coverage (or remain liable.)

Is worker's comp needed for a home business that employs immediate family members?

Small business, like any other business, must follow the laws concerning those businesses and that also pertains to workers comp insurance. Even though they are related to you, if you hire family members as employees of your business (with the standard benefits and pay as an other of your employees), I believe you must also pay workers comp for them. I am not an attorney, so I don't know for sure and suggest you consult professional advice. If they get injured on the job, you'll be glad you do and so will they. Taking chances such as skimping on workers comp insurance is just bad business and you'll probably sleep better knowing your business is protected.

Can workman's comp use my personal sick leave time if i was injured in an accident in the company's van but it was not may fault?

Yes of course you can also claim for personal injury and loss of earnings..My brother has a claim agency if you would like more information i can give you his number.. I don't know the answer to your question, yet consider: It's often in your best interest to use your personal sick leave time instead of Work Comp benefits, because Comp doesn't pay 100% of lost wages, whereas your sick leave probably does. If you don't want to use your sick leave, though, contact the Workers Comp case worker or the ombudsman to answer this question for you.

If an employee has to take off from work to see a doctor related to a workman's comp claim does this employee get paid for the time off or do they have to use the sick or vacation time first?

There are 2 answers here - if you have filed a workers comp claim and are waiting for it to be approved YOU can elect to use any sick leave/ vacation leave you have - BUT your employer can't just take it without your permission IF your claim has been approved- you should be receiving benefits from comp monthly IF your not Ans your claim has been approved you need to find out why!! Your sick leave has nothing to do with comp benefits. However if you elect to use your sick leave then your employer must reinstate the amount you used or pay you for it. Like I stated earlier - you should be getting a check from workers comp ----
