The judgment will remain in the Public Records section of the credit report for seven years. In some instances a judgment can be renewed,if so, it can remain on the credit report indefinitely. There is nothing that can be done to have the data removed from the CR before the required expiration date.

Is judgment proof legal in Kentucky?

Yes, judgment proof is legal in Kentucky. Judgment proof refers to a situation where a defendant does not have sufficient income or assets to fulfill a court-ordered judgment. In such cases, the court is unable to enforce collection of the judgment against the defendant.

Can defendant be kin to judge and lawyer?

The defendant can be kin to the lawyer, but a judge would probably have to recuse himself. Which means he can't sit in judgment because of interest or bias.

In the state of Texas what happens after a default judgment?

A default judgment is nothing more than a judgment obtained because defendant did not show up for court. In Texas, when a default judgment is entered, the petitioner gets all that they have asked for.

Can a request for default judgment be filed if there was no summons?

Typically, a request for default judgment cannot be filed if there was no summons served on the defendant. The defendant must be properly notified of the lawsuit before a default judgment can be granted. It is important to follow the proper legal procedures to ensure that the defendant's rights are protected.

What is Request of entry of default?

When a person (the plaintiff) sues someone (the defendant), the defendant gets a certain amount of time to respond to the lawsuit (times vary by state). If the defendant does not respond to the lawsuit within the time period prescribed or does not show up to court on the day he or she is supposed to, the plaintiff will ask for (and the court will usually give) a default judgment. Simply put, the plaintiff wins because the defendant did not make an effort to defend themselves. A request for entry of default is when the time has passed for the defendant to respond to a lawsuit and the plaintiff is asking for a default judgment. This only applies to civil cases, not criminal cases.

Can someone show an example of a case where a motion for a summary judgment will be granted?

Summary judgment is granted when there is no dispute as to any of the material facts in the incident that caused the lawsuit so that, as a matter of law, one party or the other is entitled to judgment as a matter of law. In a suit on a credit card bill, if the defendant does not dispute that he is responsible for the full amount claimed by the credit card company, but just won't pay it, the plaintiff is entitled to summary judgment without having to go to trial because the defendant admits the debt. There is no genuine issue of material fact that has to be resolved by trial. Now if the defendant denies that he is responsible for all or part of the debt (for instance if the card had been stolen and charges were billed for purchases not made by the defendant but the credit card company does not believe him) there is an issue of material fact that has to be determined at a trial. The issue is did the defendant actually make the charges or not. Summary judgment cannot be granted as long as there is a genuine issue.

What does vacate the judgment mean?

Vacate means to do away with. In court a judgment becomes final when the case is over and a judge has signed a piece of paper. The judgment is then effective until it is satisfied (by payment, or by doing whatever the judgment says) or until the judge has a legal reason to set the judgment aside. For instance if an appeal is filed, and some other judge says the first judge was mistaken, the second judge will vacate (put in suspense) the judgment. The judgment does not then have to be obeyed at that time. A court of appeals can reverse a case and change the judgment, or reverse the case and vacate the judgment (everybody starts over and you retry the case until you get a new judgment)In the UK there is a phrase known as "set aside judgment". This phrase normally describes a procedure by which judgment has been granted to a Claimant because no Defence has been filed within a prescribed time period. If however, there was good reason for this - such as the Claim was not properly served then the Defendant can apply to "set aside judgment" and if this application is granted the Defendant can enter a Defence.

Can anyone other than the plaintiff or defendant in a pending civil case file motions to be heard?

It depends. If there are multiple defendants or plaintiffs, they can all file motions. The judge can also file certain motions sua sponte, like a motion for summary judgment. There are some cases where an outside party can ask to intervene, and file a motion requesting to become a party to a civil suit, because they feel that they are interested in the outcome and that their interests will best be adjudicated within the current suit, rather than by filing a new one.

When does the defendant have to pay the money to the bondsman?

The defendant has to pay the bondsman because they are getting the person out of jail based on their word or cash they give the courts. As the defendant, you have to pay them back.

What happens when you don't respond to a divorce summons in the 20 days a lotted?

Two things to know. First, if a person does not answer the summons and complaint in the time allotted, the court will let the plaintiff proceed with the case pretty much as if the defendant agrees with all the allegations and demands made in the complaint. The plaintiff will have to prove that service of the summons was made properly just so the court is sure that the failure to answer is not just because the defendant does not know about it. The court will schedule a proof hearing at which time the plaintiff will testify to the truthfulness of the allegations of the complaint. If the court is satisfied the allegations are true, it will enter a default judgment granting the plaintiff's demands as long as those demands are supported by the facts. Second, the court will not cut off a defendant from filing an answer just because the 20 day period has expired. All courts have rules that permit filing a late Answer provided there is some reasonable reason for the lateness. Plaintiffs's lawyers know that courts will allow late answers very liberally, so much so that they usually consent to a late answer without making the defendant ask the court to be allowed to file late.
