If you petition the courts for a compitency hearing or you have not already been placed on Court Ordered Treatment,then you can not be placed againest your will for more then a 72 hour observation . This can only happen if you are exibiting behavior that indicates you are a threat to yourself or others.

This is truly opinionated and is not intended to be viewed as a guide for doing anything illegal. Research your local laws before attempting anything below.

If the person has been admitted from someone else (A doctor, psych dr, police or EMS) on a "302" (Mandatory 120-hr stay in a mental hosp.) you have very little luck getting them out before the 120 hours is up (unless you follow the guide below). If the person has put themselves there "201" (voluntary admittance) they can sign themselves out the same day; as long as they don't appear to be a threat to themselves or others.

Ways around the system. (Number 3 will work the quickest and is a guaranteed way to get released ASAP!!) Try numbers 1 or 2 if number 3 doesn't work for whatever reason.

1. Get a lawyer involved and get them to call the main psych dr. at the hospital threatening a lawsuit for wrongful admittance. Once the magical phrase "lawsuit" is brought up against a hospital, the patient will likely be released within 24-48 hours.

2. Temporarily cancel the patients health insurance. BUDGETS FOR HOSPITALS ARE VERY LOW, when a patient no longer has insurance, the hospital will have no choice but to expedite the release of the patient. The hospital WILL NOT hold the patient (as long as they aren't a threat to others or themselves!) once the insurance is cancelled or suspended. NOTE: It will take 24-48 hours before the insurance company contacts the hospital and the hospital releases the patient. Don't do it on a weekend, you'll get no where fast.

3. As a patient, transfer yourself to the closest drug rehab (chemical dependency) program. A lot of them are on the same property as mental health. As long as you tell your psych doctor you have a history of drug abuse, you aren't feeling suicidal or homicidal and you need rehab asap, you will usually be released to rehab within 24 hours MAX! Once you are transferred to rehab, you can legally sign yourself out of the hospital (even if you were 302'd into the place to begin with). If you DO sign yourself out of rehab, be warned your insurance may not cover any of the costs of being there because you didn't stay the full 28-days for the drug rehab program!

DISCLAIMER: Escaping or attempting to escape from a mental hospital will result in CRIMINAL charges and even worse, MORE TIME IN A MENTAL HOSPITAL. If you ARE feeling suicidal or homicidal, consider actually trying to learn something and better yourself in the hospital. Ask yourself how you got there to begin, and stop trying to blame everyone else around you for YOUR problems. Depression is temporary. Life is too short to waste, make the best of it :)
