How do you know if the person you are talking to is asleep?

They don't answer. :) If you're talking about texting, I usually wait about 10 minutes for them to respond. If they don't within that amount of time, that usually indicates that they've probably fallen asleep. If they end up texting you a half an hour later, it's their loss! Answer their text in the morning.

If you're talking about a phone conversation, usually they don't respond to you when you ask them questions or talk to them..? So hang up!

The same thing goes if you're talking to someone in person. However, if you've made them fall asleep, obviously you've done something wrong! Spice up the conversation!
