If the Sheriff's Dept. is not able to serve your spouse directly with the papers because they can not locate him, the next step is to post a public announcement of filing for divorce in the local newspaper. If he doesn't see it - that's his problem. If you can't get your spouse to cooperate or to "surface" and face the fact that you are divorcing him. you will end up being granted your divorce by default. The only problem is that if you are looking for a property settlement or cash settlement - don't count on it. The law is not going to use its limited resources to hunt your X down and make him pay.

In courts the word serve means to present someone with documents, or papers. These papers inform the person that someone has filed a case that involves them.
Does your state require that you have "reason" to get divorced? Most states are now "no fault" so it doesn't matter why you want a divorce, you can just get one. If you do not want to sign the divorce papers as they stand, make your spouse change the offensive parts with the understanding that you will sign the new papers without a problem. Find out if you are a no fault state. Then you'll know how much weight your outrage holds. In no fault, if you don't sign, he can still proceed. Make your life as simple as possible since it's gonna happen anyway. Then get yourself a down and dirty divorce attorney and take him to the cleaners!

You may need to provide the court with a year range such as between 1985 and 1995 but the courts index cases under the names of the parties. You can call the court for instructions on how to obtain a copy.
Is he married here or in his home country? My husband went to the Mexican consulate here in the U.S. and got papers to give power of attorney to his sister in Mexico. She was then able to get a divorce for him. It took about 6 months. If his wife is here in the U.S. then I think it would be the same as any divorce between two U.S. citizens.
