When Obama says that ISIL is not a state, he is not saying that from a geopolitical theoretical perspective, but rather from a political one. He is claiming that based on the barbarity of its actions and usurpation of legitimate political power, ISIL does not have the right to join the community of nations.
If we analyze ISIL from a geopolitical perspective, neutral to its promulgation of violence and terror, we see many of the indicia of statehood, such as (1) exclusive right to use violence within its borders, (2) control of a swath of territory, (3) internal administration of justice, etc. What it lacks is primarily recognition and its own viable currency, but it will likely have the latter, not the former.
