It is considered a "wobbler". The district attorney can file either felony or misdemeanor. If a person is sentenced with a felony and does NOT serve State Prison sentence and only county jail time, it is a MISDEMEANOR after the probation time has been served. This is according to 17 (B) 1 of the California Penal Code. If a person is sentenced to prison, then it is charged FELONY with a FELONY conviction. Thank you.
Sounds like being in possession of a controlled substance within a State Prison or jail or on prison/jail property.
ALL Felony offenses have prison time attached to them.
Felonies are more than one year sentence in prison. Have you been to prison? If so you are a felon. Town, city, village or county jail is usually for misdemeanors.
The maximum penalty for a Class B Felony in Hawaii is 10 years in prison. The average person charged with this felony typically only serves 18 months in jail and is given probation.
Unknown what it is that is being asked. A felony carries a prison sentence of a minimum of one year in jail.
5 years in a Federal prison.
Felons are not a "protected class" of citizens (i.e race, gender, sexuality). Therefore if a landlord is knowledgeable of the fact that a potential tenant is a felon they are within their right to refuse. However, if a person has been in jail with no felony charges, then they cannot. This is where the use of prison/jail comes into play. Under normal circumstances Jail is reserved for any person(s) spending under 365 days (non felony) whereas Prison is for felons (365+ days). If a person has only been convicted of misdemeanors, violent or not, a landlord cannot refuse tenancy on that basis.
It depends on several factors, such as where you are and what the felony is. In my state, it can range from a couple of years in jail to life in prison, depending on what the crime was.
The difference between felony and misdemeanor probation is the felony is when a person is sentence to a jail term, but it can be served out of jail. The misdemeanor probation is not given jail time. They serve a probation period.
Such questions are meaningless unless the actual charges and State are known.
You go to jail or prison!
