Child support is generally paid to the one who has the major part of the custody but when you split it more equal the one paying pays less since he then have the child more than earlier and therefor pay already while the child is in his custody. He has to apply for the child support to be reduced though based on the new custody agreement.

How does joint custody affect child support in Georgia?

It depends on the type of joint custody. Custody is broken down into two subcategories- legal and physical. Legal custody is the ability to make decisions concerning the child and to act on the child's behalf. Physical custody is who the child lives with. Typically unless the child spends exactly 50 percent of the time with each parent, one parent is considered to have primary custody and the other parent to have secondary custody or visitation rights. Child support is based on who has primary physical custody, and that parent is typically awarded child support from the parent who has the child less since having the child more usually means that you provide for more of their needs as well.

What happens to child support when I have sole custody of my 2 children and 1 decides to move out with his mother?

Nothing happens automatically. The mother will need to contact the courts to get the child support amount adjusted. It's not an overly complicated process, but, with a bias in the courts toward the mother, it is rarely a fair 50% split. As the male, your child support might be cut down to less than half of what you receive today. It depends on how the child support number is calculated in your state.

When two parents split up but were never married what type of custody does the mother have by default if the father has a visitation order and pays child support?

It's all up to the courts to decide. A mother can request full sole legal custody of the child even if the father has visitation rights and pays child support. The mother does need to prove to the courts why full sole legal custody is in the child's best interest.

Do the parents split the tuition of private schooling with joint custody?

With most child-support questions, the answer is always "look in the child support order". If it doesn't specify, then if the parents can decide between themselves to split the cost, then there's no problem. If they can't decide, then they'll need to go back to court.

Can the father of your child stop you for taking your baby out of the state and visiting your family?

No, I don't believe they can. It depends on the agreements of the split custody; if there is split custody. Technically, the law only forbids a parent moving out of state with the child if there is split custody, but if there is full custody, I do believe that its allowed. In any case if you're only visiting, Theres nothing in the law that prohibits you. I grew up with divorced parents, although there were no custody agreements.

What is reasonable child support and allimony payments?

Half your income. The larger portion towards children. Keep in mind if you have massive deductions on your paycheck, they will reduce the amount YOU get as your CS/SS payments will be fixed. 401K will be split down the middle and all your accounts and property 50/50. But, if your wife/husband is a frivilous spender and has been bringing you to financial ruin for years, you will be better off financially AFTER he/she's out of your accounts.

50% of anything is one half. With 50% physical custody the child would split their time equally between the parents.
