MA is one of the few states that has kept ALL of its criminal records (back to the early 1900s). Since convictions often keep people from being employed, the MA Legislature made substantial revisions to the statutes pertaining to the sealing of criminal records in 2010, amending s. 100A of ch. 276 of the General Laws of Massachusetts. That change put new verbiage in place until May 4, 2012 and another change took effect after that date. The changes are too lengthy to include here, but both are currently in s. 100A of ch. 276.
The new law, effective May 4, 2012, states in essence that anyone with a misdemeanor conviction is eligible to have his record sealed 5 years after release from court supervision, with exceptions. Anyone with a felony conviction is eligible to have his record sealed 10 years after release from court supervision. One must apply to have a record sealed.
