Depends on the state. In AZ, it is 10 days in jail, first offense, plus a fine, I think it's $250. And, a point on your record. And, you get a court-ordered ignition lockout on the car, at your expense, and for a year, I think. That is, if your car is new enough to take one.<smile> That is, for a simple DUI and not double the BAC limit or aggravated or causing accident while under the influence, vehicular manslaughter, underr age, etc.
I think CA is a fine and point, only. Last I was there.
NY had a mandatory prison on first DUI for a while--I don't know if it was shot down or not. I'm sure the ACLU jumped in and protested.
