It depends on whether there are provable fault grounds for a divorce or whether you are divorcing on no fault grounds. If it is for fault you can proceed immediately to file for a divorce and there is a 90 day waiting period. If it is no fault the parties have to live separate and apart for a period of one year.

You have to be separated for one year before you can file and then it usually takes about two more months.
