Slaves were tortured in ancient times in any court case against their masters, since they were thought to give a false testimony otherwise. The same goes for the hundreds of millions of Russian slaves kept from Medieval times until 1865 when they were freed. Their masters could torture them at will and no record of it was ever kept. And finally, many forms of execution or punishment would - often even then as now - be considered a form of torture, from keelhauling to drawing and quartering to bungled beheadings - or bungled 'death by injection' cases in US prisons today.
