The debate over states' rights has been going on since the writing of the constitution. There are many people who believe the tenth amendment shouldn't apply to serious and lawful offenses.
There were four amendments added to the United States Constitution during what is known as the Progressive Era. The Constitution currently has 27 amendments.
The Declaration of Independence was written during the summer of 1776. The Constitution of the United States of America was written during the summer of 1787. If my math is correct, then eleven years passed between the writing of the Declaration of Independence and the writing of the Constitution of the United States of America. 9 states were needed to ratify the Constitution
The Constitution set forth a strong central government. The states were not going to be happy with giving up many of the rights they exercised during the previous years.
There were still just the original thirteen states at the time. Twelve of them sent delegates to the Constitutional Convention. Rhode Island was the one that did not participate.
Article VII of the US Constitution required 9 states to ratify the Constitution for it to be effective.
