Is that between a child's parents? if so it is ultimately up to the parents. But, most parents will let the child decide who they want to live with.
They can decide, but it's not going to be left to them to have the final say in it.

At 18 you can choose where to live.
In the US we have freedom of speech. They can say anything they want to. However, their saying it isn't going to change the laws. A judge might consider their wishes in granting custody.
