They asserted their right to hunt whales based on their oral history of whaling being part of their past culture. Whaling by the Makah was suspended earlier because commercial whaling had depleted whale stocks so much. They also asserted that their right to hunt whales was guaranteed by treaty with the US government. The 1855 Treaty of Neah Bay, states in part: "The right of taking fish and of whaling or sealing at usual and accustomed grounds and stations is further secured to said Indians in common with all citizens of the United States." They have not only asserted the right but have followed through by taking at least one whale since courts confirmed their right to do so.
The agricultural methods that the Makah Indians practiced were very simple. The used some sharp blades and digging sticks to till their land.
