The colonies were obtained by mainly English expansion westwards from the 16th century onwards. Colonies were established during the reign of Elizabeth 1 - hence the name Virginia - but they failed. Colonisation expanded rapidly (and brutally) during the 17th. As territory was taken from indigenous peoples they became colonies in their own right based on English customs and laws. In short, they were stolen.
