By the relevant authorities giving you a swab test. this is where they ask you toplace a cotton swab in your mouth and basically swish it around. this picks up your saliva they then analyse it and it comes up with a positive or negative readding. they can use the swab in court to prove your DUI. one way to avoid this is to have a solution of very salty water in your car next to you. as you are about to get pulled over put the solution in your mouth and swish it all around, if possible spit the solution out for the simple reason it tastes gross! if thats not then swallowing it wont do u any harm and is a leaner punishment than being charged with DUI and having your licence suspended.

Are their differences in a DUI for drugs and a DUI for alcohol?

Yes, but they depend on the type of drug. A DUI for a "soft drug" such as marijuana is going to be completely different than a DUI for a "hard drug" such as Meth. The difference is in how much the drug will impair your driving. Small amount of marijuana, for example, have been shown to only have minor affects on drivers. Below is an article on DUI on marijuana and one for DUI for methamphetamine.

Just because you were allegedly taking legally prescribed medication has nothing to do with driving under their influence, or not. "Under the influence" is under the influence, period. Someone is just as dead from being killed by someone driving on prescribed medication as they would be if they were driving under the influence of crystal meth.
