Probably not..first off, if your finalized, it's pretty much a done deal.

Your refund this year was for income and taxes you had withheld last year...which were prepetition. You could have had all your income withheld....and delayed on filing your return till a year from now...it wouldn't change that the refund is an overpayment of withholding from earning from before you filed...that would have otherwise been able to be used to pay your debtors.

This stimulus check...while what the heck it actually is may not be terribly clear....it's easier to say it is just an early refund of your 2008 filing...and hence POST petition.

You have past tax debt in chapter 13 bankruptcy Will you still get your stimulus check?

Unless the Internal Revenue Service has made a mistake, any tax owing is due and payable whenever income is generated. This means that there will be no stimulus check issued.

How do you fix a judgment against you when the company that sued you has filed bankruptcy?

The judgment becomes an asset of the bankruptcy estate and thus the "property" of the trustee. The trustee may decide to abandon the judgment as not worth collecting, or may pursue its collection. Either call the trustee's office or check the docket and documents in the bankruptcy court. If by "fix" you mean pay, check with the trustee's office before sending any money or bank check to anyone. You may be able to settle the claim for less than the full amount. If you are uncomfortable doing it yourself, get a bankruptcy lawyer.

Do you receive a check when filing bankruptcy?

Sorry, the question is confusing. In bankruptcy the filer reliquishes all non-exempt assets to the trustee, I have no idea of what type of "check" you could be referring to.

Can You still get my tax refund check from 2007?

Sure. Most people can get their 2007 refunds until April 15, 2011. But it is too late to get the stimulus check based on your 2007 tax return that was mailed in 2008. If you did not get your stimulus check, you have a second chance to get a stimulus check based on your 2008 return which you are filing in 2009.

Is it unusual that a check wrote to a bankruptcy court gets signed and deposited by the trustee?

That's how it's done. Its deposited by the court actually, who not have arms and legs, that type of thing, has the trustee actually do it.

Does the court check with employers regarding bankruptcy?

No. The trustee, appointed in every case, might check with an employer in a rare case. In almost 40 years, I have never had it happen.

When in a chapter 13 bankruptcy for more than 4 years and receiving money for a 100 percent disability that happened after filing bankruptcy can bankruptcy take the settlement?

"Bankruptcy" does not take anything. The Chapter 13 Trustee is the one who "takes" anything there is to be taken. And, no, your settlement - if you mean a retroactive check for disability (SSDI) - is not available to the trustee. If you are talking about a settlement of a lawsuit, probably not, unless the cause of action existed at the time you filed the c. 13 and did not exempt any possible award. Talk to your bankruptcy lawyer.

If you are entitled to a large inheritance right after bankruptcy how much can the trustee take?

Your bankruptcy trustee has the right to receive your share of the inheritance within 6 months of filing your case. The trustee has the right to receive it all. Typically what happens though is the trustee receives the full amount and then makes a determination of how much is needed to satisfy your estate and debts. If you receive more than is necessary to pay off your debts, you will get a refund. It can take some time though. In rare cases, the trustee may have you cut a check for the amount and you keep the difference. But normally trustees don't trust debtors to do this.
