I have the azure flute but i didnt use action replay or mystery gift and it wont let me use it Why cant i use it?

Talk to the mystery gift guy in celestic town. he will give you an azure flute. then go to the spear pillar. it will say," your names azure flute is making a sound! blow into azure flute?" Say, yes and a stairway will appear go up and arceus is on the little platform. Go forward and you will see it. ONLY TRY IF YOU ARE PREPARED. It will take a really long time. Buy at least 50 ultra balls. and maybe 5 quick balls. then try to catch it.

No. There was a special Arceus event that could be used to get an Arceus , but if you didnt do that, you must get an action replay, or get the the azure flute via mystery gift for Diamond, Pearl, or Platinum. Bear in mind that if you did not do the special 12th movie Arceus event, you can only get one of the Dialga, Palkia, or Garatina that comes out of this event. But also keep in mind you dont have to catch all the legendarys in heart gold to do this event.
