You may have been "served" with a formal public notice in the legal paper of the county, usually in the local legal notices in the want ads sections, not necessarily the largest metropolitan paper in the area... ask the court clerk in your jurisdiction if you can have a copy of the record of service (may have a copying fee), since you are the named party... Maybe it's now a moot point & the only recourse is to pay off the debt, interest & fees... many small claims judgments might be dischargeable in bankruptcy proceedings, but for that advice, see a specialized bankruptcy lawyer... When a lien is filed on a property in Oregon can you contest it?

The time to contest a creditors claim of an unpaid debt is when and the creditor has sued you for the debt and the matter is in court for the hearing. If you miss your opportunity to defend against their claim, the judgment will usually be in the creditor's favor and the court will issue a judgment lien. Once the lien is issued and recorded in the land records you cannot sell or mortgage your property until the lien is paid. The time to contest a creditors claim of an unpaid debt is when and the creditor has sued you for the debt and the matter is in court for the hearing. We are not the one supposed to stop them we would just defend ourselves from them and make some barrage. Other animals are there to feed on them to decrease their number.

Can a collector use a judgment to garnish your wages if you were not served a lawsuit summons and given a chance to defend yourself in court?

It is possible for a creditor to receive a judgment by default when the debtor does not appear on the date of the trial (hearing). In most instances all that is needed is for the creditor plaintiff to make a reasonable attempt to serve the person named on the civil summons and not necessary for the summons to be physically placed in the defendant's hands.

What will happen to you if you are sued for credit card debt?

The attorney representing the creditor states the facts of the case, the debtor is allowed to defend his or her position. The only legal defense for nonpayment of debt, is that the debt itself is not valid. Although it is difficult to understand, the inability of the debtor to pay due to a job loss, injury, illness, or other personal difficulties, is not accepted as a viable reason for not paying one's debts. The named defendant does not have to appear in court when it pertains to a creditor lawsuit. However, a nonappearance will result in the plaintiff being awarded a default judgment against the debtor/defendant. The creditor can then execute the judgment against any nonexempt property belonging to said debtor.

If you did not appear in a case of judgment creditor debtor Only because the plaintiff did not have your known address and you could not be notified of the court date Is the judgment contestable?

I would thinks so. You have a right to defend yourself and its on them to notify you of the date. If they never told you when then due process was not followed

Is that the actual spelling of defend?

Can car company put lien on house if person is on SSI and can't pay car loan Voluntary repossession.?

Not directly, and not always. In order to put a lien on a house a creditor must have a "judgment" against the person who owns the house. In order to take a judgment, the creditor usually must repossess the car, sell it at a commercially reasonable sale, credit the proceeds (less costs of taking and sale) to the account, and demand the remainder as a "deficiency" balance. If the debtor doesn't pay the "deficiency", the creditor can sue in the civil courts. The debtor usually has 30 days to answer the deficiency claim, and there are MANY, MANY defenses to deficiencies. For example...that the creditor did not give the debtor the option of a public or private sale; that the creditor, after repossession, did not give the debtor a fair opportunity to redeem the vehicle; that the creditor violated the consumer's rights in taking the vehicle without a court order over active and unequivocal protest; that the creditor overcharged the debtor on interest, finance charges, insurance premiums, documentation fees, etc. The debtor may even have a counterclaim against the creditor for violating repossession laws, which in any event would equal the finance charge plus 10% of the cash price. This is where an experienced consumer defense attorney is essential. Bear in mind, however, that the creditor can forget about the repossession of the collateral and sue directly on the obligation, which would make the debtor have to defend at an earlier stage.
