It depends on who it was that actually put up the bond amount. If it was you, family, a friend, etc, the bail will be refunded by the court since it is no longer necessary to hold it as insurance that you will appear in court. HOWEVER - if the bond was posted by a bailbondsman, the fee that he charged you is NOT refundable. The fee he charges is for putting his money "at risk." the fact that you weren't a risk, is immaterial, he still tied his money up in you.

If you get a bail bond through a licensed bail agent and pay that agent a bail bond premium (typically 10%-15% of the total bond...so a $10,000 bond would have a premium payment of $1000-$1500) that premium is not refundable. Just like any other insurance policy you purchase the premium you pay the company is not refundable.

Added: On the other hand - if your bond was posted by private funds (e.g.: personal funds supplied by your spouse - family - friends - business partner - etc) as long as you fulfill all your court obligations, the full amount of the bond that they posted, minus any court fees and fines (if applicable), will be returned to them at the end of the court process.

Is bail typically determined within three hours after an arrest?

It depends on the type of crime charged. In most cases, a person charged with a misdemeanor or a lower level felony, the person will be processed and bail set within a few hours. In cases of more serious crimes, or in cases where the arrested person must be held for other reasons, it may take some time before bail can be considered.

If a bail bond is exonerated do you get a refund from the bail company where you posted bail with?

Exoneration of a bail bond simply means that the defendant has been adjudicated and the bail liability has been released from the bail bond agent. When a bail bond is posted and a fee is charged by the bail agent that fee is non-refundable no matter if the charges are never filed, the defendant gets parole revoked and put back into custody, or the defendant is adjudicated.

Is it possible that a person be put in jail for a case of oral defamation even if the person is not proven guilty or the case is still on the court?

Oral defamation is a tort, not a crime. However, if a person is charged with a crime (for example, harassment may fit here), that person will be arrested. If they are not allowed bail or cannot make bail, they will wait in the county jail until their case is called to trial.

What is the difference between anticipatory and interim bail?

Under the law in India, there are several different types of bail. Anticipatory bail is something that you can get before you are arrested, in anticipation of being charged with a crime. Regular bail is post-arrest: being released, pending trial, and interim bail is a temporary release for a short period of time... for instance, sometimes the courts won't grant regular bail, but will allow the person a short amount of time for a specific reason.

If out on bail and arrested for something else does the bail money return to the person who posted it?

I am in the same situation. My fiance was arrested, but I had posted bail. Then probation violated him, so now he is incarcerated yet my bail has not been released for the previous arrest. The time he has served does not account towards anything because technically he is out on bail. How do I go about getting this bail revoked so the clock can start ticking ?

What is an American bail bond?

An American bail bond is the act of paying a jail a certain amount of money to release someone who has been arrested. The condition is that if any court dates are needed the bail bondsman will find the person who was arrested if they skip court. There is also a bail bonds company from Longview, Texas called American Bail Bonds (although this question specifically asks about American bail bond and not American Bail Bonds).
