While it will depend on state laws, in the United States the victim of a domestic violence (in this example, the wife) may not deny the government her statement nor evidence, that may be on her behalf as the victim. The government is the complainant, or prosecutor, not the victim. The victim is a witness and does not have a right to choose whether to prosecute. Technically, failing to comply with a subpoena or failing to cooperate with govenment investigation may give rise to an Order to Show Cause and possibly arrest and incarceration. However, in cases of domestic violence it is often supposed that the cause for denying, or failing to cooperate with law enforcement, is fear of retaliation by the accused. Therefore, procedures to assure compliance by the victim are rarely, if ever, used.
