Yes, in most states you can be criminally prosecuted; however, if prosecution proceed after a urine drop for say an employment examination, you should pursue charges of your own for HIPPA violation. It won't protect you from prosecution unless your attorney has the wherewithall to pursue evidentary procedure, however wrong is wrong.

No. Just being around marijuana smoke cannot make you fail a UA. The levels taken in would be too low to show up in a standard UA given by a probation officer. Also they can send the sample in to a lab to see how high the levels are if you do fail.
