First, only a company or an individual with a judgment can lawfully higher a collections agency to recover a debt, so I assume this was a business eBay seller? The short answer, contact an FDCPA attorney because the collections agency is breaking the law. In every lawful transaction there must be consideration, they provide you with an item, you provide them payment. However if they have never sent you the item, and you have never sent them payment, there is nothing to collect. This action also violates Ebay terms of service, since they do not allow for sellers to do that, I would report them to Ebay also. Any eBay seller knows that if the buyer does not pay, eBay refunds all fees; so there is no loss on the sellers side.
