Even in California it is up to the couple to agree to separate for awhile and not live together to be sure they want a divorce. If you both have any doubts about whether the marriage is able to be saved then separation is the way to go. If after a period of time one or both of you has met someone else or, you have decided you are no longer in love then one or both of you can file for divorce.
