A creditor who wins a lawsuit judgment for debt can execute the judgment in several ways other than wage garnishment. A judgment can be used to levy bank accounts (including those that are joint), seize and sell non-exempt property belonging to the debtor, place liens against real property owned by the debtor (including jointly titled property). Social Security and VA benefits are exempt from creditor attachment. Private retirement benefits may or may not be protected from creditor action depending upon the laws of the state in which the debtor resides. Kentucky is a tenancy by the entirety state and they can't take anything that is in both spouses name. If you don't need to depend on your credit ratings and the credit card is in your name only, in the state of Ky. they can't take a darn thing because it is protected by the tenancy by entirety law. The CC will just to have to take the loss.
