Normally, yes, unless they have already sold it. They have not sold it. They say I have been held up by a government agency that approves gun ownership? What is with that? I did not buy the gun at the pawn shop, so the Brady Bill background check and waiting period should not apply. I only borrowed money on it to fix my car. In light of the recent Supreme Court ruling guaranteeing my second adnendment right to own a gun, isn't the pawn shop violating the law in refusing to let me reclaim the gun? It depends on what they mean. When you redeem a pawned gun, they have to run a background check on you, just like when you buy the gun for the first time (even though you're not buying it from the pawn shop. It's not their rule, it's a federal thing). If there is a waiting period in your state, then you have to abide by that waiting period. If not, then whatever normal paperwork is required by the Feds (a 4473 form) and any other paperwork, if any, that is required by your state. If your state does not do insta-checks, then it's however long it takes for the paperwork to come back. Here in Tennessee, it's pretty much instant, done by computer. Hope that helps. Its the federal thing that is in question here. I thought the recent SC ruleing upheld my rights, reguardless of any state or federal agency that doesn't like it. What can I do?

Do pawn shops do a background check before you pawn a firearm?

Not before the firearm is pawned. To pawn a firearm, you must have proof of your identity. Before the firearm can be redeemed when it has been pawned, the pawn shop will have you complete a Form 4473, and conduct a background check, same as if you bought the gun from them. If you cannot pass a background check, the firearm CANNOT be returned to you. You can SELL it to the pawnshop, or have them sell it on your behalf.
