You have the right to choose your counsel. As such, your new attorney will be entitled to the work product produced at your expense. If you owe money to the previous attorney, you may, in many states, be required to pay that balance before he will release the documents. This is, in some states, known as a retaining lein. But in the end, you should not have to pay to have the same work done again.
