It is not illegal to refuse to submit to a breath or blood test in Texas. You have the right to refuse such tests. However, there are civil penalties which may automatically apply if you refuse to comply with a law enforcement request to take such a test. Your driver's license can be revoked for 180 days for a first offense refusal to take the breathalyzer test.

The UK Police can request a breath, blood or urine test if they have reason to believe that you have been operating or are in charge of a vehicle whilst under the influence. In these circumstances, it is a criminal offence to refuse to provide a sample. The offence of refusing the provide a sample carries the same disposal as the offence of driving under the influence.

While the answer varies by state law, the general answer is that you have the right to refuse but you will lose your license if you do refuse. In Oregon, for example, you are required to take a breath test. You do have the right to refuse, but if you do refuse your license is suspended for at least one year regardless of the outcome of the DUI charge.
If you breath or have a blood alcohol level of .08 your license will be suspended.
refuse to take a test to show you are driving under the influence of alcohol or drugs
Casually give them a mint gum or candy and if they refuse say please take it...
You are. The "implied consent" law has been tested in court. It holds up for breath and urine testing, but the Supreme Court in Missouri v. McNeely (2013) ruled states must obtain a warrant for blood testing.
You should clarify your answer. I assume you meant to ask "Does a drunk driver have to submit a blood sample?" To my knowledge, all states have implied consent. That means that by driving you automatically give consent to submit to blood alcohol testing. The police will not hold a gun to your head until you submit, but if you refuse, your penalties are much higher. Also, you can submit a breath sample too. It doesn't have to be blood. In the 50 or so DUI's I've written, I don't think I've ever had to use blood. They either sumit a breath sample or refuse altogether.
No, you cannot refuse the gratuity if it is clearly listed on the menu. However, if it is not listed you may refuse it. Otherwise it is considered a unilateral contract. By reading the menu, you agree to pay the gratuity added to parties 6 or more, 8 or more, after 12, etc.
You can refuse a field sobriety test and that is your right and you cannot be punished from refusal alone. If you refuse a blood or urine or breathe test then you automatically have your driver's license suspended for a year.
