If you were pulled over for DWI but only given a citation for careless driving can you later be charged with DWI if you see a hearings officer?

I doubt that any documents supporting a DWI exist. If you had been under the influence when you were stopped, you probably would have gotten a ride to jail. It would also be nearly impossible to prove because the officer would be placed in the position of defending his decision NOT to arrest you, and would likely become the star defense witness.
