Yes, assuming the spouse can otherwise legally own a gun. The problem you run into is when the non-felon spouse has the gun in the house. Short explanation: the felon cannot own or possess a gun, so if there is any chance the felon could access the gun, there could be a problem.

01/10/13: According to the State of Alabama Board of Pardons and Paroles website. A person who was convicted in the State court can receive essentially two types of pardons.

1. A pardon that reinstates your right to vote only. So called "Political Rights".

*2. A pardon that is the same as the political rights requested, but will also include restoration of your "Civil Rights". (You can also indicate if you would like to have any misdemeanor convictions pardon for bonding or nursing purposes).

Pardon type *2 is considered a full pardon. However, certain exclusion may be noted on the pardon certificate, such as; Firearm restriction, Sex offender registration, or Habitual offender status (3 strike your out law). Only 2% of the Pardons granted will not have any restrictions. These three restrictions described are most common.
