The judiciary interprets the law to ensure it is applied fairly and consistently, resolving disputes between parties. It also serves as a check on the other branches of government by reviewing the constitutionality of laws and actions.

The Chief Justice in Kenya is responsible for the overall administration of the judiciary, including assigning judges to specific roles, presiding over important court cases, and representing the judiciary in interactions with other branches of government. They also play a key role in safeguarding the independence of the judiciary and upholding the rule of law in the country.
In a democratic system which is comprised of 3 branches of government namely: the Judiciary, the Legislative, and the Executive' the functions are, therefore, divided and limited. Whereas the functions of the judiciary is to interpret the law, the legislative branch is the one that creates it and the executive administers or implements the law.
