You will always have a spell in use on Oblivion. If you don't want to use that spell, then simply select a different one. :)

There isn't one. There is only weakness to fire, frost, shock, magic, and normal weapons spells in oblivion. There is a weakness to disease spell in Morrowind, i think.

You need to cast a spell with a soultrap effect before you kill the enemy. The effect only lasts for a limited time, depending on the spell, so make sure you can kill them fast enough after casting. You may need to cast it mid-combat to be sure. There are also several weapons and scrolls that cast this effect as well.
