Those who are defending the Proposition before the Supreme Court would argue that it is. They would say that a federal court has no business second-guessing the judgment of the electorate of California, a majority of whom voted to take away the right to marry from same-sex couples. The would say that the state has a right to establish its own marriage laws without interference from the federal government. However, they would be overlooking the fact that the Supreme Court of the State of California was the first to rule that it was unconstitutional for the majority to remove the civil rights of a minority for no legitimate reason. It should also be noted that it was the supporters of Proposition 8 that appealed to the federal courts, thinking that they would get a more favorable decision there. The ultimate outcome of the case is yet to be decided by the US Supreme Court some time before June 30, 2013.
