However, before the end of the final battle Draco Malfoy, along with both his parents, defected and therefore managed to avoid imprisonment.

Draco Malfoy is indeed a Death Eater in Harry Potter and the Half-Blood Prince, but not a particularly capable one. While Draco did manage to perfect the Vanishing Cabinet that gave the Death Eaters access to Hogwarts, Lord Voldemort had given Draco the crucial assignment of killing legendary wizard Albus Dumbledore; but Draco failed in that, and it was left to Severus Snape (The Half-Blood Prince) to carry out the assassination with a timely curse of Avada Kadavra.

It's hard to say, but I'd go with 'no'. Because his family, the Malfoys, were all Death Eaters and very close to Voldemort (especially Bellatrix, his aunt), he was forced into being a Death Eater. He was also supposed to kill Professor Dumbledore, but he couldn't bring himself to. If he enjoyed being a Death Eater, then he would have enjoyed killing things, but he never did - only hurting them. He was malicious, but not evil.

Note: I think he changed his opinion during his sixth year: in the beginning he seemed to be proud and determined; but in the end (after a sequence of serious crimes) he couldn't murder Dumbledore.

yes he has the mark i believe on him but only in either the last book deathly hollows or the halfblood prince .... he is not a death eater in the first 5 books ....
