The answer depends on the precise place you are living. In the US there are many areas (counties/cities) that still have ancient laws on the books that count any act of sexual intercouse that is not a man penetrating a woman through her vagina as sodomy and still call it a felony. Some call it a misdemeanor. In the US, of course, it would never carry any official weight (though it might come up in a trial to sway a jury if a lawyer feels the jury is full of idiots....)
