If the music is being distributed free of charge by someone who is not the owner, then they have no right to offer the music. The owner of the music is the person or company who own the rights to the work. It might be the artist but more commonly it is a record company or publishing company. Although "theft" or "stealing" are not the right legal terms in most jurisdictions, at least morally, downloading music without the permission of the owner is stealing.
