Execution, or capital punishment, as a form of punishment for a person who was convicted by a legitimate court has been used by most societies. Most countries have abolished it some have not. Some states in the United States have abolished it and some have not. Capital punishment is considered a controversial issue. In countries where human rights are not adhered to and all the citizens do not have equal rights under the law or execution is used for political purposes then it may be considered an illegitimate use of power.

Is it legitimate for a government court to sentence someone to death?

If doing so follows the constitution, laws, regulations, and statutes of the land, it is legitimate for a government court to sentences someone to death. Some may feel that a death sentence is murder or that taxation is a form of theft or even that corporal punishment, maiming or torture as punishment is a form of excessive cruelty. That would not negate the legitimacy of the government behavior if it falls within the laws of the government. That is why the United States constitution includes the Bill and the Eighth Amendment which forbids excessive bail and cruel or unusual punishment and the U.S., Supreme Court has decided that the death sentence is legitimate, but only under certain conditions.

It would still be a crime. I can't reasonably imagine how this could possibly be true, but if it were, it might be a mitigating factor in their sentencing.
