There are many things that can lead to a poor outcome in surgery. Negligent acts only account for a small percentage of these. A patient may have an allergy to a medication used or the patient's body may be too weak to heal after surgery.
I don't think so. Doctors can only do the best they can with the situation that is thrown at them. My wife is going to have to 18th surgery for a shattered elbow from falling off of a horse. After 14 or so surgeries to try to rebuild it, it got infected and everything had to be removed. She now has no elbow and will have to wear a permanent brace. All of the surgeons did the best that they could. These things happen and they cannot always be fixed.

He had a vein in his throat that kept bleeding. With out the surgery he wouldn't be able to "scream"anymore, so he had surgry to have the vein removed.
