if you are comparing the water and Ice then it is neither. they are both the same.

From one point of view you have a mixture - even though they are the same - one is in the solid state and the other is in the fluid state.

From another - its an homogeneous substance since they are the same element.

To be literal as to your question: which is about the ICE itself and the water is not actually the substance in question. With that then the Ice is a substance and as long as it is ICE is is not mixing with the water. When the state changes from solid to liquid the melted liquid has become the other substance and is no longer ICE.

Assuming both were made from pure water, this would be an example of a pure substance. Even though the substance is in two different states of matter, they are still the exact same molecule.
