Technically it is theft-even from a garbage can! Some states are very strict on this-usually ones that offer money for cans and glass etc. The charges can escalate from theft, to criminal damage, trespassing and even robbery. Added: I somewhat disagree with the first answer, which might apply if the receptacles are still located on private property. HOWEVER - the courts have ruled that garbage and trash set out on 'public space' for collection is "abandoned property" and there is no legal protection for it.
