In some states, yes, 'texting' is now specifically outlawed. In all other states, although the laws may not specifically address 'texting' there are laws which address such things as "failing to give full time and attention to the operation of a motor vehicle' which would certainly apply.

Not only illegal, but dangerous and stupid as well. +++ As comparison, in the UK it is illegal to use a portable (cell) phone anyway while driving, though I'm not sure of the legal position of "hands-free" equipment. Mine is a conventional cell 'phone - but it stays switched off!

Generally speaking, the duty of care owed to others is to behave as "a reasonably prudent person." For example, you might be held liable for hitting a pedestrian with your car while texting, even if texting while driving is not illegal in your state. The jury or judge would have to find that a reasonably prudent person would not drive and text at the same time.
