Until you file for divorce, or legal separation - there is no legal requirement as to where your children reside. And as you may be smart enough to comprehend - this divorce and mom and dad living in different homes, etc. is going to be very hard on the kids. Who gets to decide where the kids stay? And what if that is not agreeable to one of you? Get a lawyer and get the paper's filed and get an arrangement worked out concerning the kids - and this, of course, includes child support, children's healthcare....If you think you can unofficially start "divorcing" yourselves from each other without things getting ugly (which really hurts the kids) then prepare for it to all hit the fan. And remember that until you legally separate or divorce, any debt incurred by your wife is still your responsibility. Cancel your credit cards now.

If neither has been given custody, and it's not an official divorce or anything, then the wife/ex-wife should at least let him see the kids, as its hit right to until someone says otherwise.
