Yes it is legal to give homework over any holiday break. You are not required to do the actual work during a time you are religiously prohibited but you are expected to have it completed somehow by the due date.

Yes - it is absolutely legal - especially if the teacher stated up front or if an external entity, such as the school district, has set a policy that homework is part of your grade.

It's not bad - so long as you get the work done, it doesn't matter when you do it. The best way to do homework is to give yourself a short break - maybe one hour - after school and then buckle down and get it done before bedtime.
