If the photo was taken in a studio by a photographer for instance, the photographer knows he needs a signed "release" authorizing use of the photo. These can be a general release for any purpose or for only specific purposes. People have no "reasonable expectation of privacy" if they are out in public areas, say, on a public sidewalk. Photos taken there may be used freely. Many photographers would ask for a release anyway, to prevent problems.
