Simple Assault is defined as an "unwanted touching." To be classified as "simple" it must involve an unarmed contact using nothing more than the hands - - unless the person doing the touching is a trained boxer or martial artist - in that case his touching automatically is classfied as a 'battery' because of the skilled use of his hands.

To be honest, it depends on the scale of the push. If a push was intentful and wished to cause harm to the person, then yes it could be classed as assault. The definition of assault is a violent physical or verbal attack so if the push was violent and the person landed on the floor, it is assault (again!). This is a very confusing issue because how do you determine the extent of a push? But if a bit of pushing and shoving between two people is classed as assault nowadays, what is society turning out to be???

Another View: If it was an intentional push or shove - YES - it is an assault. It does not have to pass some test to determine if violence was intended or not.

Legally -- ANY unwanted touching, done with intent, is assault.
