snakes have backbones so they are considered vertebres, but an interesting fact about them is that they have a pelvic bone which really serves no purpose because they don't have any legs, well not since the devil pulled his stunt with Adam and eve.
The awnser to this is: earthworms are cold blooded. They are also inveretebrates which means they have no backbone to support them they only swiggle around.
